We Collect Information from:

  • Applications, questionnaires and other forms you submit, such as your name, address and income
  • Your transactions with us and others, such as account balances, fees, payment history, checks, parties to transactions and credit card usage
  • Our communications with you, including recent copies of checks and our responses
  • Credit bureaus (to determine your eligibility for credit or other financial products)
  • Public sources, including census data and real estate record
  • Vendor lists and membership lists, including magazine subscription lists

  • Other financial services providers, such as credit bureaus, securities broker-dealers, insurance companies and other companies with which we have joint marketing agreements (CA Residents: we will not disclose information about you to other financial service providers with which we have joint marketing agreements, other than as required or permitted by law, unless you authorize us to do so)
  • Non-financial service providers, such as retailers, online and offline advertisers, airlines and companies who help market our products
  • Carefully selected business partners (e.g., so they can alert you to their valuable products and services)
  • Non-profit organizations and other third parties, as required or permitted by law or when you permit us to share information about you

OUR SECURITY PRACTICES

We Have Safeguards to Keep Information Confidential and Secure:

  • We have up-to-date physical safeguards, such as secure areas in buildings; electronic safeguards, such as passwords and encryption; and procedural safeguards, such as customer authentication procedures to prevent identity theft.
  • We restrict access to information about you to only those employees who need to know that information for business purposes.
  • We carefully select and monitor the outside companies that we hire to perform services for us, such as mail vendors who send out our statements. We require them to keep customer information safe and secure, and do not allow them to use or share the information for any purpose other than the job they are hired to do.
  • We train our employees on these security procedures, and we conduct regular audits to verify our compliance with the procedures.

YOUR OPT-OUT CHOICES

You have the right to limit how we share information about you. You also have the right to limit solicitations from us.

LIMITS ON HOW WE SHARE INFORMATION:

  • You may tell us not to share personal information about you with outside companies, except we may disclose information as required or permitted by law. Required disclosures are made, for example, to outside auditors and banking regulators. Permitted disclosures are made, for example, to vendors assisting us in opening, maintaining or servicing your account. (CA, ND and VT Residents: To the extent that state law applies, we will not disclose information about you outside our corporate group of companies, other than as required or permitted by law, without your express authorization.)
  • You may tell us not to share any credit data about you (i.e., financial data we get from credit bureaus or from you that helps us determine your eligibility for credit) within our corporate group of companies. We do not disclose credit data outside our corporate group of companies. (VT Residents: We will not disclose credit information about you within our corporate group of companies, other than as required or permitted by law, unless you authorize us to do so.)

LIMITS ON SOLICITATIONS FROM US:

  • You may tell us not to solicit you by mail, telephone or e-mail for products and services that are not directly related to your account and that are outside our regular communications with you (such as your monthly statement, customer service e-mails or when you call our customer service center). If you tell us not to solicit you, we will not allow information about you that is shared by affiliates within the Mountain Commerce Bank organization to be used for that purpose. JOINT/MULTIPLE ACCOUNTS:

If you have a joint account, your opt-out applies to every person on the account. Your opt-out election applies to all of your accounts with Mountain Commerce Bank.

WHY WE COLLECT AND SHARE INFORMATION

By knowing more about our customers, we and our business partners can provide specialized products and services that may be of interest to you and your family. We can help protect you from identity theft and fraud by verifying your identity when you open an account with us and when you make transactions. Also, by using “cookies” when you visit our Web sites, we learn about which parts of these sites consumers find most useful.

PRIVACY AND SECURITY TIPS TO PROTECT YOUR ACCOUNT

  • Protect your information. Never give your Social Security number or personal credit information over the phone or the Internet unless you initiate the communication. Keep your personal identification number (PIN) and password in a safe place. Try to memorize your PIN and password and do not write them down with your account information.
  • Destroy and/or securely store your account records. Tear or shred receipts, bank statements and unused credit card offers. Keep billing statements and other account related documents in a safe place.
  • Immediately report lost or stolen checks, credit cards, ATM or debit cards.
  • Memorize your personal identification numbers—do not carry them in your wallet.
  • Promptly review all monthly financial statements and immediately report any discrepancies.
  • Retain receipts from all ATM, debit and credit card transactions. When you are ready to dispose of them, make sure your account number is not readable.
  • Immediately sign new credit cards.
  • Report unusual telephone or e-mail inquiries or other suspicious activity to your telephone company or local law enforcement authorities.
  • Learn about the Children’s Online Privacy Protection Act (COPPA) and follow the tips for parents at the Federal Trade Commission’s web site for children’s privacy at http://www.ftc.gov/bcp/edu/pubs/consumer/tech/tec08.shtm. We respect the privacy of your children, and we comply with the COPPA. We do not knowingly collect or retain personally identifiable information from individuals under the age of thirteen online.
  • Regularly review your credit report. Keeping your credit report error free is important. Order a copy of your credit report and report any mistakes to the credit bureau and the creditor reporting the information. See www.ftc.gov for more information on how to request one free credit report per year from each credit bureau. The three national credit bureau agencies are: Equifax - www.equifax.com 1-800-685-1111, Experian - www.experian.com - 1-888-397- 3742, and TransUnion - www.transunion.com 1-800-916-8800
  • Check your billing statements. Review your statements thoroughly. Contact all your creditors immediately if you notice incorrect transactions.
  • If you lose your credit card or suspect that you have been a victim of identity theft, immediately notify your creditors, local law enforcement and the credit bureau agencies listed above. If you think your identity has been stolen, you may want to visit http://www.consumer.gov/idtheft, sponsored by the Federal Trade Commission.
  • Update your personal information as necessary by calling us using the customer service number on your account statement or contacting your local Mountain Commerce Bank banking office.

PRIVACY POLICIES AND PRACTICES WITH RESPECT TO THE INTERNET

This Privacy Notice applies in its entirety to Internet and personal computer transactions. This Notice is provided to help you understand how we protect your financial privacy, just as we protect your financial assets. Collecting Information:

The information we collect from you as you communicate with us using our web site(s) includes “cookies,” your IP address, and your email address.

Cookies:

Cookies are small pieces of information sent by us to be stored on your Internet browser which help us recognize you and better serve you when you visit our site. We use cookies for marketing (this allows us to present products and services that may be of interest to you), site personalization, web tracking, and online ordering. We do not use cookies to obtain data from your hard drive, email address or personal identifying information. Most browsers can be configured to inform you when cookies are set or to prevent cookies from being set. Please note, however, that by not accepting cookies you may limit the functionality we can provide when you visit our site.

IP Addresses:

When you enter our web site, you pass through a “firewall” we use for security purposes. As you pass through it, we identify the Internet Protocol or IP address associated with the device you are using, such as a personal computer or handheld device. The IP address does not identify you personally, but it does allow Mountain Commerce Bank to identify the device you are using. We store IP addresses in case we ever need to track a connection to its point of origin for security reasons.

Online Forms and Applications:

If you submit an application or form online, we will collect the information you send in an electronic database. This information includes the information you submit on the application or form as well as your IP address. We use this to help us process your request and as a security measure to protect against the loss, misuse, and alteration of data used in our systems.

E-mail:

When you send us an email we will use your email address to reply to you, and, for a limited time, we will store your email address, your message, and our response for quality assurance. We may also do this to meet legal and regulatory requirements. If we collect your email address in this manner, we will not use it to contact you about Mountain Commerce Bank products and services unless you have given us permission, in which case we may let you know by email about other products and services which may be of interest to you. You may reply to any email message we send to you to notify us that you no longer wish to receive e-mail messages from us in the future.

Sharing Information with Outside Companies

Co-branded and Alliance Relationships: Mountain Commerce Bank has established relationships with other parties on the Internet to offer you the benefit of products and services we may not offer. Mountain Commerce Bank offers you access to these other companies either through the use of hyperlinks to their sites from our site, or through offering “co-branded” sites in which both Mountain Commerce Bank and the other company share the same URL, domain name, or pages within a domain name on the Internet. Generally, we do not own the co-branded and alliance companies, and we do not control how those companies use any information you supply them. It is important, therefore, that you understand each company’s privacy policy if you visit their sites. However, if you are providing information to Mountain Commerce Bank , we will always adhere to the Mountain Commerce Bank Privacy Notice.

Third Party Service Providers on the Internet:

Occasionally you will notice on mcb.com that services are “Powered by” or “Provided by” content providers or technology service partners. We contract with these providers to help us serve you better. We are selective in choosing these companies, and they are only allowed to use your information for the purpose of providing the services for which we have contracted them to provide.

Security

We have implemented standards of technology and operational security on the Internet to protect your nonpublic personal information from loss, misuse, alteration, or destruction. Specifically, information that is collected for processing or to keep as a Mountain Commerce Bank record is transmitted directly to our secure internal database server, and information stored there is not accessible to parties outside of Mountain Commerce Bank via the Internet. Our employees and contracted vendors are required to comply with our security, privacy, and confidentiality standards and practices.

E-mail:

Messages sent via the Message Center (accessed under the Messages & Alerts tab) within Online Banking are secure. However, other email you send us may not be secure unless we advise you that it is secure prior to transmitting your message. Therefore, we recommend that you do not send us confidential information such as social security or account numbers via unsecured email.

YOUR ROLE IN SECURITY:

It is important that you protect against unauthorized access to your accounts. We recommend that you do not share your password and that you exit any applications when you finish using them.

AGGREGATION SERVICES:

There are a number of companies that currently offer aggregation services which consolidate your account information from several sources. While we recognize that you may want to use this service, we want you to know that providing an aggregator with your authentication information may result in unauthorized access and use of your confidential account information by the aggregator or a third party if adequate controls are not in place. Therefore, you should ensure that the aggregator company has appropriate processes in place to ensure the privacy and security of your information.

IMPORTANT INFORMATION ABOUT CREDIT REPORTING

We may report information about your account to credit bureaus. Late payments, missed payments or other defaults on your account may be reflected in your credit report.
